The judgement could be “injunction granted”.... “ interim injunction continued pending trial “...” injunction refused”

Either of the first two are very very bad news for kits being on sale any time soon :ph43r:
Where does it say the judgement can only be 'granted', 'continued' or 'refused'?

Surely it could be damages also?
Wasn’t suggesting it could only be those three...Simply putting forward lilkey possibilities :thumbsup:

Can’t see damages being awarded without a full evidential hearing ??

As far as I recall, and my Civil Remedies Honours tutorials with Prof G Maher were 20 odd years ago, in Scottish interim interdict proceedings there is no prospect of damages. The remedy sought is the prevention/cesssation of a potential/ongoing harm/delict/contractual breach, etc. My recollection could be wrong, of course. However, as you suggest, absent evidence, how could any Court quantify loss or damage? In interim proceedings, I cannot see how any Court could make any financial award other than, potentially, in respect of expenses.

English Law may well be different, but I suspect the same considerations and principles must apply.
